General
1. These terms of use relate to the website https://healthslips.com.au (healthslips) operated by healthslips.com.au Pty Ltd (us, we or our). These terms of use also cover the services we provide in connection with healthslips, including our calculator.
2. You can find out more information about us at healthslips.com.au.
3. You are only authorised to access or use healthslips if you accept and agree to these terms. Your continued use of healthslips is acceptance of, and agreement to be bound by these terms and any changes to it. If you breach these terms, we reserve the right to suspend, limit or terminate your access to healthslips.
4. We may amend these terms from time to time, and any amended terms will be effective on publication to healthslips.
Disclaimer
1. While we take great efforts to keep the content on healthslips up-to-date and review and update each page regularly, the information on healthslips is for general information only. It should not be taken as constituting professional advice.
2. The calculator we offer on healthslips is designed to assist you in finding your cheapest health insurance and uses prices regulated by the government. These prices are uploaded into our systems once a month. We do not sell health insurance. Commercial arrangements do not affect the information we provide and there is no mark-up or discount on any prices in our calculator. They are the regulated price based on the information you enter. Our calculator is intended to inform you of the cheapest prices available based on your information. However, user error does happen so please take care when entering your information as wrong user data may cause inaccurate results.
Content on the website
1. Unless otherwise indicated, or is otherwise clear from the circumstances, we control the copyright and other intellectual property rights in the content and design of healthslips.
2. You must not copy, modify, translate, publish, broadcast, transmit, communicate to the public, distribute, perform, display, sell or reproduce, any material contained in healthslips in whole or part without our prior written approval (or where we do not control the relevant rights, without the prior written approval of the owner of the relevant rights), except as permitted under law.
3. Trade marks and/or logos may be displayed on healthslips from time to time. These trade marks and/or logos must not be used without the prior written approval of the relevant owner.
4. You must not manually or by automatic means copy, modify, download, scrape, harvest, mirror or otherwise aggregate information from or through healthslips without our prior written permission.
5. In some instances, you may be able to post user-generated content on healthslips (for example, using the Disqus tool to comment on our blog posts). You must not post any content on healthslips that:
  - (a) infringes another party’s intellectual property rights or contravenes any applicable law or regulations
  - (b) that is obscene, harassing, offensive, fraudulent, defamatory, unreasonable, dishonest, misleading or deceptive or violates the privacy of others
  - (c) promotes other commercial entities.
6. We reserve the right (but are not obliged) to delete, reject, edit or remove any user-generated content on healthslips that does not comply with these terms.
7. You grant us a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, adapt, modify, communicate to the public and otherwise exploit any content you submit to or post on healthslips for any purpose we regard as appropriate, including promoting healthslips.
Links
1. We welcome links from other websites or in any other manner that share the information we provide and promote our business provided that those links do not:
  - (a) disparage our reputation, (including the reputation of our related bodies corporate, officers, and employees or advertisers)
  - (b) misuse our intellectual property
  - (c) give the false or misleading impression that you are sponsored or endorsed by us.
2. Our website may contain links to other websites that are external to healthslips. We have no direct control over the content or operation of any linked website and we are not responsible for those website’s content or operation. Inclusion of any linked website does not imply our approval or endorsement of the linked website or its contents by us.
Prohibited uses
1. You must not use healthslips to create, use, send, store, or run viruses or other malicious code, files, scripts, agents, or programs, or circumvent or disclose the user authentication or security of healthslips or any related network or account.
2. We are proud that our commercial arrangements do not in any way affect the prices or information we offer and that our tools and information are available freely for users. In turn, we require that you:
  - (a) do not use healthslips in any way that competes with our business
  - (b) use healthslips for your personal, non-commercial use only unless we give you our prior written consent otherwise.

Liability
1. Although we take care to ensure otherwise, we do not guarantee that:
  - (a) you will be able to access healthslips at all times
  - (b) your access will be uninterrupted or secure
  - (b) information found on healthslips is current, accurate or complete
  - (b) healthslips is free of viruses and bugs.
2. Except as imposed by law, in no event will we be liable to you or any third party for any direct or indirect loss arising from:
  - (a) your use of healthslips
  - (b) your reliance on any information found on healthslips
  - (c) any technical failures, delays in operation or transmission or malfunctions in equipment or software
  - (d) loss of profits, sales or business
  - (e) loss of anticipated savings
  - (f) loss of use or corruption of software, data or information
  - (g) work stoppage
  - (h) any consequential, special, or exemplary damages arising out of or related to the transactions contemplated under these terms, even if apprised of the likelihood of such losses.
3. You indemnify us against all liabilities, losses, damages, costs and expenses (including all legal costs, whether incurred or awarded) suffered or incurred by us in relation to any breach of these terms by you.
Disputes
1. In the event of any dispute arising from your use of healthslips or these terms (Dispute), you must first give us written notice of the Dispute setting out the details of your concerns. Within 30 days of receiving your notice, we will use reasonable efforts to attempt to respond to you and resolve the Dispute.
If you are not satisfied with our response after that 30-day period and you still require resolution of the Dispute, you agree you must submit and participate in mediation of the Dispute in accordance with and subject to the Resolution Institute’s Mediation Rules. The mediation is to be conducted by a mediator appointed by agreement of the parties or, failing agreement, by a mediator appointed by the Resolution Institute.
A party may not commence proceedings in respect of a Dispute unless the Dispute is not settled within seven days after the mediation has taken place or such other time as the parties agree in writing.
Miscellaneous
1. These terms are governed by and must be construed in accordance with the laws of New South Wales. You agree that the courts of New South Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these terms or its subject matter.
2. If any provision of these terms is prohibited, invalid or unenforceable in any jurisdiction in which healthslips is used, that provision will, in that jurisdiction, be ineffective to the extent of the prohibition, invalidity or enforceability without invalidating the remaining provisions of these terms.
